August of 2004

Christopher Bowe in New York and Geoff Dyer in London reported on August 26 that GlaxoSmithKline (GSK), the manufacturer of Paxil, agreed to pay $2.5 million in order to settle a lawsuit brought by New York Attorney General Eliot Spitzer. While this was one of the Paxil lawsuits that was civil in nature, it was brought by the top-ranking criminal enforcement official in the State of New York.

The crux of the controversy was that Attorney General Spitzer had alleged that GSK had withheld clinical trial data showing that Paxil was harmful to children. As part of the settlement, GSK was to publish all its research results within an agreed timeframe.

However, GSK issued a statement that the charges brought by Attorney General Spitzer were unfounded, and only paid the settlement to avoid the high costs of litigation. AG Spitzer’s biggest priority, per his own comments was to achieve full disclosure on the data that GSK had allegedly compiled.
